Terms of Service - BP Logger

1. Definitions

Company (referred to as either "the Company", "We", "Us" or "Our" in this Agreement) refers to Nineth LLC, 2719 Hollywood Blvd, Hollywood, FL 33020, United States.

Application refers to BP Logger, the blood pressure tracking application provided by the Company.

2. Acceptance of Terms

By downloading, installing, or using BP Logger ("the App"), you automatically agree to be bound by these Terms of Service. If you do not agree to these terms, please do not use the App.

The App and all associated intellectual property rights belong to Nineth LLC and its licensors. Unauthorized copying, modification, distribution, or reverse engineering of the App is strictly prohibited.

3. Medical Disclaimer

⚠️ Important Notice

BP Logger is a wellness tracking application and is NOT a medical device. The App is not intended to diagnose, treat, cure, or prevent any medical condition or disease.

All content and information provided by the App is for informational and educational purposes only. You should not rely on the App as a substitute for, nor does it replace, professional medical advice, diagnosis, or treatment.

Always consult with qualified healthcare professionals before making any decisions related to your health or medical treatment. In case of a medical emergency, call emergency services immediately (911 in the United States).

4. Description of Service

BP Logger is a blood pressure tracking and wellness application that allows you to:

Manually log blood pressure readings from your home monitoring device
Capture and extract readings from photos of handwritten notes or blood pressure monitors using AI
Track and visualize your blood pressure trends over time
Store notes, medications, and related health information
Create profiles for multiple family members (Premium and Family plans)
Export your data as CSV files or PDF reports
Share reports with healthcare providers

Privacy-First Data Storage

By default, all your health data is stored exclusively on your device. You can use BP Logger without an account. We offer an optional account creation feature if you wish to back up your data and sync it across multiple devices.

Your data is stored in a local SQLite database. If you use the App as a guest, uninstalling the App will permanently delete all locally stored data.

5. Third-Party Services

BP Logger integrates with third-party services to provide certain features. By using the App, you also agree to comply with the terms and policies of these services:

Firebase Cloud Functions: For AI-powered image analysis only. Images are processed anonymously with EXIF data stripped and deleted within 24 hours.
RevenueCat: For in-app purchases and subscription management
Analytics Services: PostHog, Langfuse (optional, anonymous, uses app-generated device ID only)
Firebase: For authentication and optional cloud backup (if you create an account)

Note: Account creation is 100% optional. You can use all core features of the App as a guest.

We are not responsible for the practices of these third-party services. Please review their respective terms and privacy policies.

6. User Responsibilities

As a user of BP Logger, you agree to:

Provide accurate and complete health information
Maintain the security of your device to protect your locally stored data
Keep your device's operating system updated to ensure the App functions properly
Accept App updates, which may be necessary for continued functionality and security
Be responsible for any data usage charges from your mobile carrier when using the App (e.g., for image processing or analytics)
Regularly back up your device or create an in-app account to prevent data loss, as health data is stored locally by default
Not use the App for any illegal or unauthorized purpose
Not attempt to hack, reverse engineer, or compromise the security of the App

We strongly advise against jailbreaking (iOS) or rooting (Android) your device, as this may compromise the App's security and your data protection.

7. Subscriptions and Payments

BP Logger offers both free and paid subscription plans:

Free Plan: Limited features including 30-day history and basic charts
Premium Plan: Uo to 3 family member profiles, unlimited history, advanced analytics, PDF/CSV export
Family Plan: All Premium features plus up to 5 family member profiles

Subscriptions are processed through the Apple App Store or Google Play Store. Billing, refunds, and subscription management are subject to the policies of these platforms. Subscriptions automatically renew unless canceled at least 24 hours before the end of the current period.

We offer a 7-day free trial for paid plans. You will not be charged until the trial period ends unless you cancel before then.

8. Data Accuracy and User Responsibility

While BP Logger's AI extraction feature uses advanced technology to read blood pressure values from photos, the accuracy depends on image quality, lighting, and monitor display clarity.

You are responsible for verifying that all logged readings are accurate. Always review AI-extracted values before saving them. BP Logger is not liable for any errors in data entry, extraction, or storage.

9. Limitation of Liability

To the fullest extent permitted by law, Nineth LLC and its creators, officers, employees, and affiliates shall not be liable for:

Any indirect, incidental, consequential, or punitive damages arising from your use or inability to use the App
Any health-related decisions made based on information provided by the App
Loss of data, profits, or business opportunities
Errors, bugs, or interruptions in the App's functionality
Third-party services or content accessed through the App

Our total liability to you for any claim arising from your use of the App shall not exceed the amount you paid for the App subscription in the 12 months preceding the claim.

10. Dispute Resolution

Arbitration Agreement: Any disputes arising from these Terms or your use of the App shall be resolved through binding arbitration in accordance with the rules of the American Arbitration Association, rather than in court.

Class Action Waiver: You agree to resolve disputes with Nineth LLC on an individual basis only. You waive any right to participate in a class action lawsuit or class-wide arbitration.

Governing Law: These Terms shall be governed by the laws of the State of Delaware, United States, without regard to conflict of law principles.

11. Termination and Data Deletion

You may stop using the App at any time. To delete your data:

Delete your account: If you created an account, you can request account deletion within the App or by contacting us. This will remove your email and all backed-up data from our servers.
Uninstall the App: This will permanently delete all locally stored health data from your device.
Subscription cancellation: Manage your subscription through the App Store or Google Play Store.

Important: If you are using the App as a guest, uninstalling the App permanently removes all your data. If you have an account, ensure you delete your account before uninstalling if you wish to remove data from our servers.

We reserve the right to suspend or terminate your access to the App if you violate these Terms or engage in fraudulent, abusive, or illegal activity.

12. Changes to These Terms

We may update these Terms of Service from time to time to reflect changes in our practices, legal requirements, or App features. When we make changes, we will:

Update the "Effective Date" at the top of this document
Notify you through the App or via email (if applicable)

Continued use of the App after changes are posted constitutes your acceptance of the updated Terms.

14. Severability

If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions shall remain in full force and effect.
